How to perfect your application to kick-start the new year with the best chance of success!

Obviously nothing is a given, but follow these tips and you will create a brand which is in the best position to be successfully registered.

  1. Always be distinctive!

The key to a good brand is for it to stand out from the rest. Therefore, you need it to be distinctive. This is also a requirement stated in the Trade Marks Act 1994 for an application to progress passed the initial stage of consideration.

      2. Always do a search!

A big barrier to an application is the existence of an existing trade mark. To prevent this letdown, a trade mark search will ensure that your proposed mark is free to use.       3. Be flexible

In the majority of successful cases, the original mark applied for is the one that becomes a registered trade mark.
