Top tips for the perfect brand in 2017
Obviously nothing is a given, but follow these tips and you will create a brand which is in the best position to be successfully registered.
- Always be distinctive!
The key to a good brand is for it to stand out from the rest. Therefore, you need it to be distinctive. This is also a requirement stated in the Trade Marks Act 1994 for an application to progress passed the initial stage of consideration.
2. Always do a search!
A big barrier to an application is the existence of an existing trade mark. To prevent this letdown, a trade mark search will ensure that your proposed mark is free to use. We recommend an advanced trade mark search which does have a fee compared to the free search offered to get the most detailed results you can.
3. Be flexible
In the majority of successful cases, the original mark applied for is the one that becomes a registered trade mark. However, you may need to change your original plans, especially if you are hit with an opposition from an existing trade mark owner. Also, come to us, The Trademarkroom, with ideas of what you want to see for your trade mark but not too fixed in your plans just in case the mark you had in mind is not suitable.
4. Avoid describing your business
Descriptiveness goes against the key feature of a trade mark which is distinctiveness. Your application will not succeed if you go with a descriptive mark. Therefore, reiterating what is above, make it original!
5. Lastly, pick your classes carefully
The classes of goods and services you register your mark for, dictate what good and services you want protection for. It is essential that you pick these carefully otherwise you may not have the level of protection you are looking for. The Trademarkroom has many years’ experience in this and can guide you through the process.
