Brand or Trademark?

We are often asked to Patent or Copyright a trademark or brand. Both a brand and a trade mark reference are correct but you cannot patent a name or copyright a name. The former protects an invention the latter ( amongst other things) a literary work (The Exxon case)

Both trade marks and brands mean the same thing. Its an indicator of origin. It tells the consumer that "I made this" and "hands off". Its a brand- think back to those days when cows were branded remember the western Chisum with John Wayne. He branded his cows to warn off the bad guys. This is what you are doing with a trade mark. You are warning people and at the same time its adding value to the goods and services you are providing. By seeking to formulate and establish brand loyalty.

A solid brand indicates whether a product has the necessary quality, ie in terms of price or novelty of a product. Any successful business needs to maintain a wide range trade mark portfolio and maintain the brand ensuring success over the years.
