Creating Your Trademark

If you are at the beginning of your branding process, you are in a great place! It is at this crucial stage in your new venture that you should select or create a trademark that is both federally registrable and legally protectable.

If you are at the beginning of your branding process, you are in a great place! It is at this crucial stage in your new venture that you should select or create a trademark that is both federally registrable and legally protectable. Your trademark will identify the source of your goods and services, as well as distinguish them from the goods and services of others.

The strongest trademarks are those which are invented words or phrases.  By creating your own word, its is unlikely that another business or entity would be using the same mark. 

If you cannot create your own word and must select an already existing word, make sure to choose one which has little to no relation to the goods and services you will be providing.  For example, the word “shoe” would be unregistrable in relation to the sale of shoes, but may be available for “dog food”. 

For greater originality you can select two or more unrelated words to create your new brand! The more creative you can be the better.

Remember that whether you create your own new word or select existing words, it is vital to ensure the availability of that mark by means of a trademark search.
