The Trademark Search and Advice Report

If you've decided on a new name for your business, product or service then you need to be sure it’s available to use. You may well have checked it out at Companies House, on Google and completed a Domain Registery check.

What you may not have done is completed a registered trademark check. This will tell us if a third party has a similarly confusing mark that may cause problems with both a) your trademark application and b) your chosen name in general.

What’s in the Trademark report?

We’ll look at the following aspects of your mark:

  1. Is your mark registrable. Not all trademarks will be eligible for registration and your application must comply with trademark law. We will advise on whether we feel your mark is at risk of being refused under what’s called Absolute Grounds- i.e. it cannot function as a trademark. We will advise on how you can improve its  chances of success! All fees are non-refundable so it’s important you realise this before you file a trademark application. A free online search cannot do this!
  2. What classes to you need? All trademarks will be classes into goods and services which is basically what you do. This can be tricky sometimes so we’ll do it for you in the report! A free online trademark search can’t do this!
  3. Risk of confusion. We’ll identify similar and identical marks that we feel may oppose your application. Although we cannot predict if an owner will oppose we can highlight the risks and advise accordingly. We’ll analyse the results and discuss these results with you. A free online trademark search cannot do this!
  4. We will conclude with an assessment of the likelihood of success!
