Energizer v Spectrum

The copyright infringement dispute between the large battery manufacturer Energizer and the consumer products business Spectrum has now been resolved. The two parties reached a settlement but the details of the agreement were not released.

The large manufacturing company has used since 1955 the brand ‘Energizer’ and has ownership over several trademarks at the USPTO, it also has copyright ownership over the ‘beam design’ used on its products. Energizer filed an infringement suit last year on December. They were arguing that Spectrum infringed and diluted their trademarks designated false origin, infringed its copyright and competed unfairly. The remedy they were seeking was a preliminary and permanent injunctive relief moreover they asked for damages, enhanced profits and other relief the court would believe necessary.

The large manufacturing company filed on the 25th of January, for a dismissal and notified the USPTO that there was a settlement between the parties.
