How do I get an EU (CTM) or Global Trademark?

If your business is trading overseas- it’s best to extend your trademark protection abroad.

There are 3 main options.

1. EU Trademark (CTM)

This is a single application that gives protection across 28 member states. An application is made to OHIM where it is examined and if successful it is published on their register for 3 months. This allows for third parties to oppose your application if they feel it is confusingly similar to their own. If no oppositions are raised your mark will be automatically registered. It takes between 4-6 months to complete the process.

2. Madrid Protocol.

Over 90 Countries are signed up to this system. If you wish to file in a number of countries then this could be the route for you. Please note however that you must have a ‘home’ application or registration in place- i.e. a UK or EU trademark. It’s also worth noting that if your home registration fails so will your Madrid Protocol application. If complication raise with Madrid- i.e. an opposition then you will have to hire a trademark lawyer in your chosen country to deal.

3. File a trademark direct in country of choice.

If you are just filing one application then it make sense to file direct. For example for have our own US attorney. Countries in the Middle East are not party to the Protocol so you must file direct.
