How long does my trademark last?
A trademark can last for 10 years.
Renewing your trade mark
To keep your trade mark in force, you must renew it on the 10th anniversary of the filing date and every 10 years after that.
There is no limit to how long you can keep your mark registered. You may choose not to renew it, or voluntarily surrender it at any time.
You can renew your registration up to 6 months before the renewal date. If we have been instructed to act as your agent then we will write to remind you 3 months before renewal is due, if you have not already renewed your mark.
How do I renew my trade mark?
You must complete forms TM11 and FS2 with the UK IPO. We can do this on your behalf.
How much does it cost?
- a fee of £200, for the first or only class of the registration, and
- £50 for each extra class
- Our legal fee of £150.00+VAT
What if I don’t renew in time?
If you do not pay your renewal fee by the renewal date, your mark becomes expired. However, you are allowed an extra 6 months from the renewal date in which to renew your registration, but you will have to pay an extra fee of £50 for late renewal as well as the main renewal fee.
Restoring your mark
After the 6 month late renewal period there is a further 6 month period where you can apply to restore your mark. If you do not renew your trade mark in the 6 months after the renewal date, you have a further 6 months, to apply to restore your mark.
You can do this with the form TM13. There is a fee of £100 on the form in addition to the renewal fee on the which is a minimum of £200 for the first class and a further £50 for each additional class. Our legal fee for restoral is £75.00+VAT
To action your request we need to know the reasons as to why you failed to renew your mark. This must be a signed statement sent in with the form.
