I've Got a New Business Name and Brand Name. How do I get an EU Trademark?

If you are trading in the UK only and wish to protect your brand name, then it’s sensible to just file a trademark application in the UK. Although limited in its geographical scope- it’s also cheaper which can be very useful for a start up. If the business expands into the EU a trademark application can be made at OHIM. If this is done within 6 months of the UK application you can claim priority (same date as UK trademark application).

To file a trademark in the UK or EU it’s useful to follow this summary:

  1. Name check. Is your chosen brand name available? We can carry out comprehensive trademark searches (free for UK and CTM) for you to check out.
  2. Does your brand name comply with Trademark Law- we will carry out an assessment of this for you in our trademark search and advice report
  3. Once the name has been decided- we need to make sure we have the right classifications. Again this is something we can do for you- all carried out for free in our report
  4. Do you want to file a word only or word plus logo trademark application- if budget allows 2 applications are best!
  5. Who will be owner of your brand- an individual or Ltd?
  6. Once all the above is in place we can file your trademark. 

A UK trademark application takes about 4-5 months; an EU trademark application takes about 5-9 months.
