Yet another Kardashian trade mark dispute possibly in the oven

During 2017, the famous Kardashian family kept their IP lawyers busy as there were trade mark matters emerging all the time.

It seems that they have not decided to slow down for 2018 as a new potential trade mark tussle emerges.

As with the system here in the UK, the US trade mark system allows a period for existing trade mark owners to oppose a trade mark application if they feel it will conflict with their trade marks.

Another similarity with the UK and US is that period can be extended by a certain period, allowing existing mark owners time to consider if they have sufficient grounds to file an opposition.

The Kardashian sisters have taken this step before pushing forward with an opposition.

The mark at the centre of the possible dispute is ‘Kardashian Bakery & Grill’ which was filed by Hratch Kardachian in regards to bakery goods.

Three companies owned by Kim, Khloe and Kourtney Kardashian have filed an application to extend the time in which to file an opposition.

This will give the sisters until 4th March 2018 to make their decision to block the application or not.

While it is clear the bakery contains their name for which they have protection, the key here is the difference in products, the new application being for bakery goods whereas the Kardashian family mainly focus on beauty, clothing and technology.

Time will tell if the sisters take the opposition plunge.
