Kylie Jenner faces further TM troubles
After Kylie Minogue successfully blocked an application by Kylie Jenner to register ‘Kylie’ as a US trade mark and settled the matter outside of court, Jenner has had further issues with another trade mark application.
Her latest trade mark application attempt was for ‘Kylie Jenner’ in relation to clothing and accessories.
She submitted this application in November 2015 in an attempt to gain the ultimate rights over her name.
However, in more trade mark woes, this application was rejected as the mark was seen to be confusingly similar to an existing trade mark.
This existing mark was ‘Kylee’ registered by Mimo Clothing Corp.
Due to this confusing level of similarity, an attempt to appeal this initial refusal was unfounded and the decision of the US Patent and Trade Mark Office was deemed final.
Unlike her family members who have been successful in various trade mark applications in the past, Kylie Jenner has been down on her luck in both attempts to protect her name.
It is not known if any further attempts will be made but if there is it will be interesting to see if there is a break in her bad luck.
