Misfits trademark lawsuit

Glen Danzig, founder of The Misfits, has filed a lawsuit against former band mate, Jerry Only, for violating the shared trademark contract, in which they had agreed ownership in 1994 of the MISFITS trademarks for merchandise purposes.

Danzig accused Only for insisting to retailers that he is the sole owner of ‘Everything that is Misfit related’ and that he was making deals with merchandisers in 2000; cutting Danzig out of any potential profits from the process. He was selling the band’s merchandise including their iconic logo; ‘Crimson Ghost’ behind Danzig’s back.

This has caused Danzig to suffer both in popularity and financially. Merchandisers do not do business with him anymore as Jerry Only made them promise not to enter any sort of agreement with Danzig. Danzig is missing out on the profit made by most of the merchandise sold and is suffering damages of $75, 000 plus interest.

On April 3rd, Gerry Danzig filed suit against Jerry Only claiming trademark infringement and is seeking royalties owed from the merchandise sold over the years.
