Specsavers success in ‘should’ve’ trade mark bid
The widely known optician brand has succeeded in its bid to protect its famous catchphrase, ‘should’ve gone to specsavers’ through the registration of a UK trade mark.
The trade mark application submitted by the brand in July was recently approved by the UK Intellectual Property Office and now enters the period in which any third party oppositions to its registration need to be filed.
The application itself centred on the registration of the term ‘should’ve’ and ‘shouldve’ as these were seen as a key part of the slogan.
If the mark does not fall foul to any objections, its registration will allow the eyewear brand from preventing anyone in the optician, eyewear and hearing sectors from using ‘should’ve’ in any form of branding or marketing.
The registration of a single word has grown in popularity and success in recent times, with Carlsberg successfully registering ‘probably’ in relation to their lager’s slogan ‘probably the best lager in the world’.
With another success story, it would not be surprising if many brands follow in registering key part of their slogan or tag line in order to give another layer of protection to their brand.
