The Co-Operative compete for “Good Life” in trademark battle

The Co-Operative have recently replaced their healthy eating food product lines “Healthy Choice” and “Naturally Healthy” with a range called “Good Life”.  They applied for the trademark in December, and started the product line in April, with 80 products in the range. Although they have applied for the trademark, the application has not yet been registered at the UKIPO due to an opposing brand and food production company, Goodlife Foods, which are using the same name.

Goodlife Foods have held the trademark of “Good Life” since 1976, and in 2011 they additionally registered “Create a Good Life” in October of 2011.

However, rather ironically, the opposing food production company sell their products in the co-op. Good Life sell two of their products with the co-op and appear to be on good terms with the company. Interestingly; both parties claimed in an official joint statement that they have an “established trading relationship” and that they are currently “in discussions with a view to resolving the matter amicably”.

Here at the Trademarkroom we have to ask the question, why didn’t they check first that this name was available???!!! We can carry out a full trademark search and advice report for just £50.00+VAT. It’s a no brainer!!!
