Trade mark application success: how long do I have protection?
It is important to understand that while a trade mark’s protection can last indefinitely, this is not without some effort.
Building a successful brand can take years, therefore it is important that your trade mark lives on for as long as your business does.
In order to do this, you need to renew your trade mark.
From registration, a trade mark lasts for 10 years.
After those 10 years, if an application for renewal is not made, the mark will expire.
You can renew your mark up to 6 months before the expiration date. It is always recommended to do this as soon as possible to prevent any delays causing the loss of your protection.
If you are successful in your renewal, you can continue to own the mark indefinitely provided you renew every 10-year period from your last renewal.
In order to successfully renew your trade mark, you must make an application to the UK Intellectual Property Office.
If you miss the renewal date, you do have the option to revive your mark in the 6 months after your application. This does incur further costs but will allow you to continue having protection.
After this, you can apply to have your mark restored, however you must have a good reason as to why you have missed the deadline by 6 months. This is only available up to a year after the renewal date.
