UK trade mark applications- forms and fees
When submitting a trade mark application in the UK, the differing forms and fees may seem quite daunting.
This is a straight forward guide as to which forms are appropriate for you and how much you should expect to spend to complete an application.
The fees in relation to a UK trade mark application can differ depending on how much protection you need and how you would like to submit your application. The recommended way to submit an application is online through the UK Intellectual Property Office’s website: https://www.gov.uk/government/organisations/intellectual-property-office
This application requires the completion of the online TM3 form at the cost of £170 for one class of goods or services.
This form can be submitted in paper form through the post but it does carry a slightly higher fee of £200. The reason for the higher fee in regards to hardcopy applications is the extra assistance required when the UK IPO receives these applications also it is their best interest to encourage a more environmentally friendly approach to applications.
In additional to this fee, an extra £50 is chargeable for any additional classes of goods or services. The classes your mark is registered for represents the industry you should operate in. You will not be protected in any other classes of goods or services if you are not registered in them.
This will obviously raise your overall expenditure.
In relation to the actual application, this is where the fees stop. However, we recommend our services to aid your application.
For a fee of £150 +VAT, The Trademarkroom can offer you our expertise and knowledge to ensure your mark and application is as successful as it can be. In addition, we highly stress the importance of a trade mark search before the submission of your application which will highlight any existing marks that could prevent your mark being registered.
While this may seem an unnecessary expense, it is vital to ensure that you will have no problems when submitting your application, which if unsuccessful can see you losing your application fee.
