How do I get a trademark?

You've worked hard to establish a brand and you love the name of your product/service or company. You carried out checks to make sure that it's available (trademark search and advice report) and now you want to a trademark application. The Trademarkroom can carry this out for you anywhere in the world.

Your first decision is where to file. Trademarks are territorial and you gain protection in the area where you file. So if you file a UK Trademark you will be protected in the UK only. If you file a US Trademark you'll be protected in the US only.

A UK Trademark is the quickest and cheapest and is ideal if your UK customer based only. Our legal fee is £150.00+VAT and the UKIPO charge £170.00NIL VAT for one class (goods and services- what you do) and £50.00 for each class above one. We will advise and draft your classes if you order a full trademark advice report.

An EU Trademark (CTM) will work for you if you trade across Europe or plan to expand- this protects you across the 28 member states. Our fee is £300.00+VAT and 900 Euro for up to 3 classes. OHIM charge 150 Euro for each class above 3. It takes between 4 and 9 months to get a fully registered trademark in the EU. There is the possibility to follow the fast track procedure if certain rules are followed for no extra cost. Please ask us about this.

A US Trademark will protect you across North America (Canada is separate). Our fees are £500.00+VAT and USTPO charge $275 per class. We have our own UK based US attorney Waheedan Jariwalla and she will answer all you US queries. http://www.trademarkroom.com/our-services/us-trademarks

If you wish to file an International trademark we can either file direct in your country and choice or through the Madrid Protocol. Prices on request as each country carries an individual fee.

Whatever route you take we will advise you fully and remain your agent throughout the process, keeping you fully updated. If filing internationally we will need a 'home' registration i.e. a UK Trademark application or an EU Trademark application to start with.
