If you have a business name- you MAY be able to protect it with a trademark.

If you have a business name- you MAY be able to protect it with a trademark.

Before you apply to protect it however you should consider undertaking some checks to make sure it’s both available and capable of being registered.

In the UK the Trademark Act 1994 tells us what can and cannot be a registered trademark. So whilst it may continue to be your business name- it may not be capable of being a registered trademark.

Our unique search and advice report can advise you on potential pitfalls.

We now offer the following service:

1. £50.00+VAT basic UK or CTM search
2. £100.00+VAT advanced search of the above plus the TM view which covers each individual EU member state
3. £175.00+VAT advance plus which includes all of the above plus a search of unregistered rights (internet search/companies house)

All will advise on the risks on complications arising (low, medium or high).

If your mark is refused under absolute grounds (can’t function as a registered trademark) and we have advised you to proceed then we will refund our fees.

The report will highlight any identical/similar trademarks that may be present.
