Keeping up with the Kardashian Trade mark disputes: Khroma makeup line triumph over Kroma EU

On 1 April 2019, the US Court of Appeals for the Eleventh Circuit reaffirmed that Kroma EU had no legal standing to take legal action against the Kardashian sisters. The main reason behind the judicial decision was due to the fact that Kroma EU did not own the rights to the Kroma trade mark.

It has been revealed that the rights to the Kroma trade mark are owned by a Florida-based make-up artist called Lee Tillett. In October 2012, Lee Tillett had granted an exclusive licence to Kroma EU to sell, import and distribute Kroma products in Europe.

In March 2013, Lee Tillett was granted an injunction against ‘Khroma Beauty’ (a cosmetic line owned by Boldface and endorsed by the Kardashian sisters).

The US Court of Appeals for the Eleventh Circuit stated that the Kroma EU’s role was to inform Lee Tillett of the alleged infringement, as it has no standing to take legal action directly.
