Monster Energy
Monster Energy, the large energy drink manufacturer filed a lawsuit for trademark infringement against the Nature’s Bounty Company and Met-Rx Substrate Technology on the 30th of January. The defendants are companies producing vitamins and supplements and are accused of using ‘Monster Energy’s’ mark in a series of drink products they have launched.
According to the claimant’s application the defendants have competed unfairly and have created a false designation of origin. The US based company argues that the defendants have been using their mark for their drink products creating a false connection with the claimant’s products in the minds of the customers. Additionally, ‘Nature’s Bounty’ and ‘Met-Rx’ have been advertising these products by the use of the phrase ‘Love the Monster’ and have been selling them in websites such as Amazon. ‘Monster Energy’ believes that the defendants have been trying to use its reputation for their benefit.
They are hoping to get a preliminary as well as a permanent injunction. They are aiming to get damages, restitution and disgorgement. If the courts agree that their accusations stand the energy drink manufacturing company is likely to get what it’s hoping for by filing this application.
