Puma stumbles in Forever 21 copycat battle

As previously reported on The Trademarkroom blog, Puma, the sportswear brand, took action against Forever 21 for their ‘copy’ of the Fenty Fur Slide.

The basis of Puma’s claim, was an allegedly blatant copy of the Fenty Fur Slide sandal which had been designed by popstar Rhianna.

These shoes and others in the Fenty collection were a huge hit and therefore would be the perfect target for copycats to monopolise on.

However, what was sold by Puma as a watertight case has hit a stumbling block.

In an attempt to take immediate legal action to prevent Forever 21 taking more infringing action, Puma filed an application to impose an injunction on the retailer.

However, this application has been dismissed, as the court found Puma had not submitted any evidence that suggests there has any financial loss or damage to their reputation which would warrant such a strong action against Forever 21.

While this does not give any indication of how the actual case will pan out, it does form a crack in what Puma portrayed as a perfect case.

Only time will tell how the case progresses.
